Hamburg City Council Minutes – August 12, 2010

Mayor Malz called the Hamburg City Council meeting to order at 7:04 p.m. Councilmember Steve Trebesch, Councilmember John Barnes, Councilmember Brian Cummiskey, City Clerk Jeremy Gruenhagen, and Deputy Clerk Sue Block were in attendance. Councilmember Larry Mueller, Maintenance Worker Dennis Byerly, and Fire Chief Brad Droege were absent.


 

Agenda Review (Added Items) and Adoption

  • Added – August Claims List
  • Added – Email from Ann Perry (Planning Consultant)
  • Added – Updated Delinquency Report
  • Councilmember Barnes moved to adopt the agenda with the three additions, seconded by Councilmember Trebesch and motion carried. All Council members present voted aye, Councilmember Mueller was absent.


 

Review Claims List for August 2010

  • Added Claim number 14590 to Sorensen Appraisals, Inc. in the amount of $250 for Land Appraisal.


 

Approve Minutes for July 13, 2010

  • Councilmember Barnes moved to adopt the July 13, 2010 City Council Minutes, seconded by Councilmember Trebesch and motion carried. All Council members present voted aye, Councilmember Mueller was absent.


 

Old City Business

  • Council discussed using the Mediacom Franchise Fee fund to purchase a sound system, projector, and projector screen for the City of Hamburg. City Clerk Gruenhagen will work with NYA City Council for their approval of using the fund.
  • Playground equipment for the Hall Park will be installed after the Shop Driveway is completed.
  • Deputy Clerk Block will be closing the pond gates this Saturday.
  • Responses on List Serve concerning wage increases for Mayor and Council; no other cities are considering wage increases for 2011.
    • Council agreed that it would be hard to justify a wage increase.
  • The hand railing by the City Shop will be installed as soon as the Shop Driveway is completed.
  • The 2011 Preliminary Budget will be ready for next meeting.
  • Construction of a Handicap Bathroom at the Hall will be put on the 2011 Budget Wish List.


 

Fire Department Report


 

National Night Out

  • Approximately 200 people attended.
  • Cost to put on the event was between $290 and $300. The H.I.P. Group budget and donations were used to fund the event.
  • The City Office received two phone calls and one email from residents stating how enjoyable the night was.
  • Council stated that planning for next years National Night Out should start two months before the event.
  • A "Thank You" to residents for attending will be put on the cities web site.
  • "Thank You" notes will be sent out to all that donated and helped with National Night Out.


 

Dennis' Report (Public Works & Utilities)


 

Mock OSHA Inspection – July 14th, 2010

  • Maintenance Worker Byerly is continuing to work on correcting the items listed.

Loss Control Follow Up Letter from LMCIT

  • The only item left to complete is the railing on the east side of the city shop doors.

City Shop Driveway/Sidewalk Update

  • City Clerk Gruenhagen and City Council agreed to have Hanson & Vasek Construction replace an additional 15 to 20 feet of curb located in front of the Hamburg Hall and to have Hanson & Vasek Construction also replace a 6' x 9' area of sidewalk next to the old sign post (Old HFD Sign Posts) and an additional 6' x 6' area of sidewalk.
  • Council discussed and decided to authorize Wm Mueller & Sons to grade the sides of the Shop Driveway and patch the street where the new curb and sidewalk was put in.
    • Councilmember Trebesch moved to authorize Wm. Mueller and Sons to do the final landscape grade and patch the city street where the new curb and sidewalk was put in, seconded by Councilmember Cummiskey and motion carried. All Council members present voted aye, Councilmember Mueller was absent.

Community Hall Ramp Canopy Repairs (Estimates)

  • Council discussed the repair of the Community Hall Ramp Canopy and decided to have Councilmember Cummiskey talk to a contractor on getting the Canopy fixed before winter.

Re-Siding Park Food Stand

  • Project will be put on the 2011 Budget Wish List.
    • Estimated Cost - $5,000 to $6,000

Estimates (Hydro Engineering) to Replace Valves (Water Tower)

  • Council discussed replacing the gate valves on the Cities Water Tower and decided to have Hydro Engineering do the work.
  • Councilmember Cummiskey moved to approve Hydro Engineering, Inc. to repair the gate valves on the Cities water tower, seconded by Councilmember Barnes and motion carried. All Council members present voted aye, Councilmember Mueller was absent.

Water Wells Usage/Water Consumption for 2010

  • City Clerk Gruenhagen is working with Jeff Dale and Aaron Meyer (Rural Water) and John Thom (S.E.H.) on trying to find an explanation as to why there is a discrepancy in the Cities water consumption versus water billed.

Rounds for August 14th and August 15th

  • Maintenance Worker Byerly will be off August 14 and 15 and needs someone to do the rounds. Councilmember Cummiskey volunteered to do the rounds for Maintenance Worker Byerly on the 14th and 15th.


 

Councilmember Cummiskey moved to recess the City Council meeting for five minutes due to the severe weather and the cities siren going off due to a possible tornado in the area, Councilmember Barnes seconded and motion carried.


 

Council resumed the City Council meeting at 8:55 p.m.

  • Diana Payne (350 Louisa St) – Home is in foreclosure – no information on who to contact. Delinquency amount will be added to property taxes in November.

I/I Abatement Program (Sanitary Sewer/Storm Water Improvements)

  • There are ten easements remaining to be obtained. The following residents have not signed:

  • Council discussed different ideas on what could be done to obtain the remaining easements.

Variance Request for 775 Park Avenue

  • Council discussed the Memo from Ann Perry and the League of MN Cities (LMC) in relation to the MN Supreme Court Ruling relating to Variance Authority. The court ruling holds cities to a much stricter standard, which considerably limits variance opportunities.
  • After some discussion the City Council decided to approve the variance request for 775 Park Avenue with specific findings of fact, as recommended by the LMC. A public hearing will be scheduled for the variance request at the next City Council Meeting.

Metropolitan LCA Local Housing Incentives Account – Resolution 2010-04

  • Every fifteen years, communities in the metropolitan area are required by the Metropolitan Council to adopt a resolution committing to goals for new affordable and life-cycle housing units if they choose to participate in the Metropolitan Livable Communities Act Local Housing Incentives Account (LCA LHIA) program. Participating in the voluntary program allows cities to compete for funding designed to support activates that encourage affordable and lifecycle housing.
  • Councilmember Barnes moved to adopt Resolution 2010-04 to continue to participate in the Local Housing Incentives Account Program under the Metropolitan Livable Communities Act (2011-2020, seconded by Councilmember Trebesch and motion carried. All Council members present voted aye, Councilmember Mueller was absent.


 


 

Property/Casualty Insurance Renewal

  • Added 2001 International HD Rescue Truck and J-5 and Trailer to Auto Schedule.
  • Council discussed and decided not to waive the monetary limits on municipal tort liability.
    • Councilmember Trebesch moved to approve that the City Does Not Waive the Monetary Limits on municipal tort liability, seconded by Councilmember Barnes and motion carried. All Council members present voted aye, Councilmember Mueller was absent.

2010 Primary Election Results

  • The City of Hamburg had 291 registered voters however only 29 people voted in the Primary Election on August 10, 2010.

2011 Preliminary Budget

  • Hamburg's proposed levy has to be set by September 15, 2010.
  • City Clerk Gruenhagen informed Council that LGA funding for 2011 will be $58,777 however due to the States deficit this could change. The LGA funding will not be included in the Cities 2011 budget. If any amount is received it can be used for projects on the 2011 Budget Wish List.
  • Councilmember Trebesch moved to hold a 2011 Preliminary Budget Special Meeting on August 24, 2010 at 6:00 p.m., seconded by Councilmember Cummiskey and motion carried. All Council members present voted aye, Councilmember Mueller was absent.

City Council Wages/Employee Wages for 2011

  • Council briefly discussed if City Council and Employee wages should be frozen for the 2011 Budget. Council decided to discuss this further during the August 24th Special Meeting.

Filing Dates for Mayor and Two Council Member Seats

  • August 3rd to August 17th till 5:00 p.m. The City office will stay open until 5:00 p.m. on the 17th.
  • Two open council seats: Brian Cummiskey and Steve Trebesch
  • Open Mayor seat: Richard Malz

City Website

  • It was suggested to list City Activities on the City Website. Mayor Malz will have them added.

Resident Request (618 Donald Avenue)

  • The owner of 618 Donald Avenue is building an addition to his home and asked if the dirt that will be dug out for the addition could be stored on the proposed (future) street adjacent to his property.
  • Council discussed and decided they did not have any objections except that the dirt has to be removed by winter and the area restored to the way it was.

Councilmember Mueller (Sewer & Water) was absent.


 

Councilmember Cummiskey had nothing further to report.


 

Councilmember Trebesch had nothing further to report.


 

Councilmember Barnes (Parks)

  • The installation of the Hall playground equipment will be headed up by Councilmember Cummiskey with the help from Councilmember Barnes, City Clerk Gruenhagen, and Maintenance Worker Byerly. City organizations will be asked to help if needed.


 


 


 

Mayor Malz

  • Mayor Malz requested authorization to purchase a Garden Hose Reel Cart for the City Park.
    • Council discussed and decided it would be a good idea to have one at the park and the money could be taken out of the Park Budget for the purchase.


 

Approve Claims List for August 2010


 

Claims List for August 2010

  • Added claim number 14590 to Sorensen Appraisals, Inc. for the amount of $250.00 for the Land Appraisal in Young America Township (33-115-29).
  • Councilmember Trebesch moved to approve the August Claims List from claim number 14560 through 14590 plus the 3 ACH payments, seconded by Councilmember Barnes and motion carried. All Council members present voted aye, Councilmember Cummiskey was absent.


 

Mayor Malz moved to recess the City Council meeting at 9:47 p.m.


 

Councilmember Barnes moved to close the City Council meeting for the purpose of land acquisition discussion for purchase of private property for the storm water pond, seconded by Councilmember Trebesch. All Council members present voted aye, Councilmember Cummiskey was absent.


 

Councilmember Barnes moved to close the Closed Meeting, seconded by Councilmember Trebesch and motion carried. All Council members present voted aye.


 

Councilmember Trebesch moved to reopen the Hamburg City Council regular meeting, seconded by Councilmember Barnes and motion carried. All Council members present voted aye.


 

Councilmember Barnes moved to adjourn the Hamburg City Council meeting at 9:15 p.m., seconded by Councilmember Trebesch motion carried. All Council members present voted aye, Councilmember Cummiskey was absent.
